Membership Terms

Article 1 (Application of these Terms)

These Membership Terms ("Terms") govern the use of the membership services ("Services") provided by Bonpoint Japan Co., Ltd. (the "Company") through the website operated by the Company, Bonpoint Official Website (the "Website").

Individuals who register as members ("Members") on the Website may use the Services provided exclusively to Members in accordance with these Terms.

By registering as a Member on the Website, you are deemed to have read, understood, and agreed to these Terms.


Article 2 (Definition of Member)

A "Member" means an individual who has accepted these Terms and completed the membership registration procedures prescribed by the Company through the Website.

Any person wishing to become a Member shall apply for membership by following the procedures specified on the Website.

The Company reserves the right to reject or cancel a membership registration if:

  • the applicant provides false or inaccurate information; or
  • the Company otherwise determines that the applicant is unsuitable for membership.

Members shall be solely responsible for maintaining the confidentiality and security of the email address and password registered upon completion of membership registration.

If there are any changes to a Member's name, address, telephone number, email address, or any other information registered with the Company ("Member Information"), the Member shall promptly update such information.

If the Company suffers any loss or damage due to a Member's failure to promptly update their Member Information, the Member shall indemnify the Company for such loss or damage.

Membership is personal to the registered Member and may not be inherited or transferred. If the Company becomes aware of a Member's death, the Member's membership shall be deemed terminated and the membership registration will be canceled.


Article 3 (Compliance with these Terms)

Members shall use the Services in accordance with these Terms, the Privacy Policy, and all other rules, policies, and guidelines applicable to the Services (collectively, the "Related Rules").

Members agree to comply with these Terms and the Related Rules when using the Website and the Services.


Article 4 (Services, Related Rules, and Service Availability)

The Company shall provide the Services to Members free of charge.

In principle, the Services shall be available twenty-four (24) hours a day, three hundred sixty-five (365) days a year (three hundred sixty-six (366) days during leap years).

The Company shall publish these Terms, details of the Services, and the Related Rules on the relevant pages of the Website.


Article 5 (Modification, Suspension, or Discontinuation of the Services)

The Company may modify, suspend, or discontinue all or part of the Services at any time without prior notice if the Company deems it necessary.

The Company shall not be liable for any loss or damage incurred by Members as a result of such modification, suspension, or discontinuation.

The same shall apply to any loss or damage incurred by a Member as a result of suspension of the Member's access to the Services pursuant to these Terms or the Related Rules.


Article 6 (Use of the Services)

The Services are intended solely for access to and use within Japan. Any additional conditions applicable to the Services shall be separately specified by the Company.

If a Member causes inconvenience, damage, or loss to the Company, another Member, or any third party in connection with the use of the Services, or if any dispute arises between the Member and another Member or a third party, the Member shall resolve such dispute at their own responsibility and expense.

If the Company incurs any loss or damage in connection with such dispute, the Member shall indemnify the Company for such loss or damage.


Article 7 (Non-transferability)

Members may not assign, transfer, or otherwise dispose of their rights to use the Services to any third party.


Article 8 (Deletion or Loss of Member Information)

The Company may, at its sole discretion and without prior notice to the Member, delete Member Information if any of the following circumstances apply. The Company shall have no obligation to disclose the reason for such deletion.

Furthermore, if the Company suffers any loss or damage as a result, the Member shall indemnify the Company for such loss or damage.

  • The Member Information is found to violate Article 10 (Prohibited Conduct).
  • Promotional materials or other communications sent based on the Member Information cannot be delivered due to invalid or outdated registration information.
  • The Company otherwise determines that the Member Information is no longer necessary.

The Company will implement reasonable and appropriate security measures to protect Member Information.

However, the Company shall not be liable for any loss of Member Information caused by force majeure or any circumstance beyond the Company's reasonable control.

Article 9 (Copyright and Intellectual Property)

The copyrights and other intellectual property rights in all content on the Website, including without limitation text, photographs, illustrations, graphics, and other materials, are owned by the Company or the respective content providers or other third parties.

Without the prior consent of the copyright owner, you may not reproduce, modify, redistribute, republish, download, display, post, transmit, or otherwise use all or any part of such content in any form or by any means.


Article 10 (Prohibited Conduct)

Members shall not engage in any of the following acts when using the Services:

  • Using any information, copyrighted works, or other materials provided through the Services for purposes other than personal use, or making such materials available to the public, whether within or outside a network, or otherwise infringing the intellectual property rights of any third party.
  • Defaming, slandering, or damaging the reputation of any third party.
  • Infringing upon the property, privacy, or other rights of any third party.
  • Transmitting or uploading harmful computer programs, viruses, or similar malicious code.
  • Violating any applicable laws or regulations.
  • Engaging in election campaigns or activities similar thereto.
  • Publishing or transmitting information, documents, images, or other content that is contrary to public order or morals through the Services.
  • Conducting communications through domestic or international networks in violation of the rules governing such networks.
  • Using the Services for commercial or business purposes.
  • Any other act that interferes with the operation of the Services or that the Company otherwise determines to be inappropriate.

Article 11 (Purchase of Products)

Members may purchase products through the Services.

Members wishing to purchase products shall place orders in accordance with the procedures specified by the Company.

Upon receipt of an order, the Company will send an Order Confirmation Email confirming the details of the order. The transmission of the Order Confirmation Email constitutes the acceptance of the Member's purchase request for processing purposes.

A sales contract between the Member and the Company shall be formed only upon the Company's transmission of a Shipping Confirmation Email notifying the Member that the ordered product has been dispatched.

If a Member orders multiple products in a single order and one or more products are not listed in the Shipping Confirmation Email, no sales contract shall be deemed to have been formed with respect to those omitted products.

The prices displayed on the Website represent the selling prices applicable to purchases made through the Website. Although the Company makes every reasonable effort to ensure that product information is accurate, errors may occasionally occur.

If an incorrect price or pricing-related information is displayed on the Website:

  • If the correct price is lower than the displayed price, the Company will charge the lower price.
  • If the correct price is higher than the displayed price, the Company may, at its sole discretion, contact the Member before shipment to confirm whether the Member wishes to proceed with the purchase at the correct price, or cancel the order and notify the Member accordingly.

Products purchased through the Services may be delivered only within Japan.

Cancellation of an order under Paragraph 2 of this Article shall be governed by the applicable Related Rules.


Article 12 (Payment)

Payment for purchases made through the Website may be made by:

  • Credit Card (Visa, Mastercard, JCB, Diners Club, or American Express); or
  • Cash on Delivery (cash payment only).

If any dispute arises between a Member and a credit card issuer, payment service provider, or other payment-related third party concerning payment obligations associated with the use of the Website, such dispute shall be resolved directly between the parties concerned, and the Company shall bear no responsibility therefor.


Article 13 (Returns and Exchanges)

If you wish to return a product, you must contact Customer Service within fourteen (14) days after receiving the product and return the product together with the required documentation. Returns will not be accepted without prior notice to Customer Service.

Returns are accepted only for purchases made through the Bonpoint Online Store. Products purchased at Bonpoint boutiques (including standalone stores and department store locations) cannot be returned through the Online Store.

Returned products must be shipped using a trackable courier service (such as Japan Post Yu-Pack, Yamato Transport, or Sagawa Express). Returns sent by standard mail, letter pack, or similar services without delivery confirmation cannot be guaranteed for refund.

If a return is made for the customer's convenience, the original shipping charge is non-refundable, and the customer is responsible for the return shipping costs.

Returns will not be accepted under any of the following circumstances:

  • More than fourteen (14) days have elapsed since the product was delivered.
  • Product tags have been removed or lost.
  • The product has been used or shows signs of wear or fitting, including wrinkles, deformation, scratches, or odors.
  • Parts of the product or accessories are missing.
  • The required return documentation is not enclosed.
  • Packaging materials such as boxes, dust bags, or shopping bags are missing.
  • Protective packaging for accessories, smartphone cases, or similar items has been opened.
  • The product is designated as non-returnable, including fragrances, skincare products, underwear, socks, swimwear, books, toys, or any other products expressly identified as non-returnable.
  • The product was purchased at a Bonpoint boutique rather than through the Bonpoint Online Store.
  • The product was purchased during a sale or from an outlet.

The Company does not offer exchanges for products due to customer preference. If you wish to obtain a different item, please return the original product (if eligible) and place a new order.

Products received as gifts cannot be exchanged or returned by the recipient. In such cases, the original purchaser must contact Customer Service.


Article 14 (Product Disclaimer)

Product images displayed on the Website are provided for illustrative purposes only. Actual colors, sizes, and appearances may differ depending on your display settings and photographic conditions.

Except as otherwise expressly provided by law or separately specified by the Company, the Company makes no warranties regarding the quality, performance, suitability for a particular purpose, compatibility with other products, or freedom from defects of any products sold through the Services, and shall not be liable for any damages, losses, or disadvantages arising therefrom.


Article 15 (Cancellation of Sales Contract)

The Company reserves the right to cancel a sales contract even after a Shipping Confirmation Email has been sent if any of the following circumstances apply:

  • The Member has provided false or inaccurate personal information.
  • The ordered product has become unavailable for an extended period or has been discontinued.
  • The order exceeds the purchase limit applicable to limited-quantity or limited-edition products.
  • It is apparent that the price displayed on the Website was clearly incorrect in light of the prevailing market price or other circumstances.
  • In the case of credit card payment, the Member's credit card issuer declines or refuses to authorize the transaction.
  • The Company otherwise determines that cancellation of the order is necessary.

Article 16 (Suspension or Interruption of the Services)

The Company may suspend or interrupt all or part of the Services without prior notice to Members in any of the following circumstances:

  • When periodic or emergency maintenance of the Website is required, or where construction or other operational work makes such suspension unavoidable.
  • When telecommunications services provided by a telecommunications carrier are suspended.
  • When the provision of the Services becomes difficult due to force majeure, including but not limited to natural disasters, power outages, war, or interference by a third party.
  • When the Company otherwise determines that a temporary suspension or interruption of the Services is necessary for operational or technical reasons.

The Company makes no representations or warranties of any kind regarding the completeness, accuracy, reliability, usefulness, or suitability of the Services or any information obtained by Members through the Website.

To the fullest extent permitted by applicable law, the Company shall not be liable for any loss or damage arising from the use of the Services or the information provided through the Website.


Article 18 (Indemnification)

If any dispute arises out of or in connection with a Member's use of the Services, a Member's violation of these Terms or the Related Rules, or a Member's infringement of the rights of any third party, the Member shall resolve such dispute at the Member's own expense and responsibility.

If the Company incurs any costs, expenses, damages, settlements, or other liabilities in connection with such dispute, the Member shall indemnify and hold the Company harmless from and against all such losses.

Article 19 (Amendments to these Terms)

The Company reserves the right to amend these Terms or any Related Rules at any time if the Company deems such amendment necessary.

In the event of any amendment, the Company will publish the revised Terms or Related Rules on the Website or provide notice by other appropriate means.

A Member's continued use of the Services on or after the effective date of such amendment shall constitute acceptance of the revised Terms.


Article 20 (Termination of Membership)

A Member may terminate their membership at any time by following the procedures prescribed by the Company.

Membership shall terminate when the Company receives and processes the Member's request for cancellation.


Article 21 (Governing Law and Jurisdiction)

These Terms shall be governed by and construed in accordance with the laws of Japan.

Any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance, unless otherwise required by applicable law.
